1. Who we are

Balladly is an AI-generated personalized song service operated by SynthWeave LLC ("Balladly", "we", "us", "our"), registered at 8 The Green, Suite B, Dover, DE 19901. This Privacy Policy applies to the Balladly iOS app, the balladly.com website, and any related services we run.

If you are a buyer, a recipient of a song made through Balladly, or a visitor to our website, this policy describes what we do with your information.

2. What we collect

2.1 Information you give us

• Account: the email address you sign in with (and a name if you provide one).
• Song inputs: the recipient's name, your relationship to them, the occasion, your free-text "tell us about them" description, inside jokes, and the genre / tone / vocal preferences you pick. We treat free-text inputs as personal information.
• Optional photo: if you choose to upload a photo for cover art, we store it for the purpose of rendering your song's cover.
• Optional voice recording: if/when Balladly offers a voice-clone feature, we'll process the audio sample you submit. Voice recordings are biometric data; we'll add specific consent + retention language at that point and you'll be asked to opt in explicitly before the feature is available to you.
• Apple in-app purchase receipts: Apple sends us a transaction receipt confirming you paid. We don't see your card details — Apple processes the payment.
• Support communications: messages you send us by email or in-app.

2.2 Information we collect automatically

• Usage: which features you use, songs you generate, retries you trigger.
• Device: device model, operating system version, app version, language preference, time zone.
• Logs: IP address, request timestamps, error reports, crash logs.
• Cookies / similar technology on the website: see our Cookie Policy.

2.3 Information from third parties

• Apple ID / Sign in with Apple: if you sign in via Apple, we receive a unique identifier and (optionally) the name and email Apple shares.
• Apple App Store: Apple shares aggregated install + revenue data with us; this is not linked to your personal identity.

We don't collect more than what's listed here. We don't ask for your contacts, your location, or any data we don't need to ship the song.

3. How we use it

We use the information we collect only to:

• Generate the personalized song you asked for.
• Deliver the song to you and any recipient you share it with.
• Run your account: receipts, customer support, account-management features.
• Detect, prevent, and address fraud, abuse, content-policy violations, or technical issues.
• Improve the app — usage patterns inform what we build next, but we don't combine anonymous usage analytics with your identity unless we're investigating a specific issue.
• Comply with legal obligations.

We do not use your information for behavioral advertising, profile-building for third parties, or any purpose unrelated to running Balladly.

4. AI processing — the specifics

Balladly is an AI service. To make your song, your inputs (lyrics-related text + the genre/tone/vocal you picked) are processed by:

• Anthropic Claude (via OpenRouter) — generates the lyrics from your inputs.
• Suno — generates the music from the lyrics.

Both vendors are based in the United States. Inputs are sent to them only to produce your song. We have agreements with our AI providers requiring that your inputs are not used to train their general AI models and are not retained by them beyond what's needed to deliver the output.

We also do not train any AI models of our own on your inputs, your generated songs, or your account information. If we ever change that, we'll update this policy and ask for your explicit consent first.

AI-generated content has unsettled copyright status in many jurisdictions. We disclose AI generation honestly in app metadata, onboarding, and on every shared song.

5. How we share your information

We do not sell your personal information.

We share your information only with:

• Service providers who help us run Balladly: hosting (Vercel, Supabase), email delivery (Resend), AI generation (Anthropic, Suno), and analytics. Each provider is bound by contract to use your data only to provide their service to us.
• Apple for in-app purchases and App Store delivery. Apple's own privacy policy applies to data Apple collects directly.
• Recipients you share songs with: when you share a song link, anyone with the link can view the song page (which shows the recipient's name, the giver's name, the lyrics, and the audio).
• Legal authorities: when required by law, court order, or to protect the rights, property, or safety of Balladly, our users, or the public.
• Successor entities in connection with a merger, acquisition, financing, or sale of assets — with notice to you and continued protection of your information.

6. Retention & deletion

We keep your information for as long as your account is active or as long as needed to provide Balladly to you, plus any period required by law (typically tax/finance records: 7 years).

You can delete your account at any time from in-app settings or by emailing hi@balladly.com. On a verified account-deletion request, we will delete or anonymize your account information, song inputs, and generated songs within 30 days.

Generated songs you've already shared (via link or social) may persist with the recipient or platform you shared to — those are out of our control after the share happens.

7. If a song is about you

If someone made a song about you using Balladly and you didn't agree to it — or you want it taken down — email hi@balladly.com with the song link or any details that identify it. We will:

• Confirm receipt within 48 hours.
• Disable the public share page within 7 days of a verified request.
• Delete the underlying song record within 30 days, unless we need to retain it for legal reasons (e.g., active dispute).

When buyers create songs, they represent that they have permission to use the recipient's name and the personal details they enter. If we believe a song violates someone's rights, we may remove it without notice.

8. Children's privacy

Balladly is rated 13+ in the App Store. The service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If we become aware that we have collected information from a child under 13 without parental consent, we will delete it promptly.

9. Your rights

Depending on where you live (e.g., California, the EU, the UK), you may have rights to:

• Access: request a copy of the information we hold about you.
• Correct: ask us to fix inaccurate or incomplete information.
• Delete: ask us to delete your information (subject to legal retention requirements).
• Port: get a structured, machine-readable copy of your data.
• Object / restrict: ask us to stop or limit certain processing.
• Withdraw consent: where processing is based on consent, withdraw it at any time.
• Not be discriminated against for exercising any of these rights.

To exercise any right, email hi@balladly.com. We respond within the time limits required by applicable law (typically 30-45 days).

California residents: we do not "sell" your personal information as that term is defined in the CCPA. We do not "share" personal information for cross-context behavioral advertising.

EU/UK residents: if you believe we have not adequately addressed your concerns, you may contact your local data protection authority.

10. International data transfers

Balladly is operated from the United States. If you use Balladly from outside the US, your information will be transferred to and processed in the US. The US may have different data-protection laws than your country. Where required, we use Standard Contractual Clauses or other approved mechanisms to protect your information during international transfer.

11. Security

We use industry-standard safeguards: encryption in transit (TLS), encryption at rest, access controls on internal systems, and regular review of who has access to what. No system is 100% secure. If a breach affecting your information occurs, we will notify you and the relevant authorities as required by law.

12. Changes to this policy

We may update this policy. When we do, we'll change the "Effective" date at the top and, for material changes, give you advance notice via the app or email. Continued use of Balladly after changes take effect means you accept the updated policy.
